Vehicle Search
The worst thing you can do is to consent to a search of your vehicle says Ryan Pacyga to caller’s question. If you refuse and they search your vehicle anyways, you can have it thrown out for an illegal search.

Field Sobriety Test
Ryan counsels a caller on if a field sobriety test should be taken. Ryan says it’s a bad idea because you can incriminate yourself. The Officer has the right to arrest you and you will have to submit to a test once at the police station or hospital.

Ever wondered if you can operate a forklift or other motorized machinery if you’ve been convicted of a DWI? Jeremy in Stillwater had his gun rights revoked due to a felony. The state has reinstated his rights but the Federal courts have not. Ryan said Federal gun laws are more strict than the state. A caller said he was never formally charged 3 years ago when he was arrested on a weapons charge. Should he follow up? Ryan told him to lay low, his case may have fallen through the cracks.

A caller wondered if there was any difference between a lawyer and an attorney. Ryan said no, they are the same thing. Sara from Minneapolis has a girlfriend being harassed by a female co-worker after hours with work-related issues. She discussed it with HR but since it’s after hours, they said they couldn’t do anything. Ryan suggested she print off the text messages and emails and show them to her employer. If nothing is still done, she can go to court and get a restraining order. Andy in St. Paul had his Internet connectivity shut down for a day for downloading proprietary movies. Ryan told him this is a Federal offense with harsh penalties. Paul was wondering if he should hire an attorney for his DWI offense or just use the public defender. Ryan told Paul they aren’t able to fight the implied consent law for his driving privileges and that most public defenders are over worked because of case load cut backs. Ryan suggested he look into hiring an attorney. Ryan also said that if found guilty of a DWI offense, it will never be removed from your record but certain charges may be able to be expunged.

Tom from Lakeville had his car parked outside of his work when it was hit by an intoxicated person. His car was impounded as evidence and the cops wouldn’t let him remove any of his personal items. The window was broken in the accident so while the car was parked at the impound lot, all of his stuff was ruined by the rain. Ryan said he could take the police department to small claims court but doubted he’d get retribution for the $2,000 loss of personal property. John from Blaine asked Ryan Pacyga when his right to own a handgun would be reinstated after a felony conviction. Ryanb said 10 years after the conviction but you have to reapply to have your gun privledges reinstated. Ryan was surprised when Vanesa from Minnetonka said her boyfriend, who is charged with a DWI with a prior felony charge, is going to court on Monday and doesn’t have an attorney representing him. The prosecution doesn’t have any incentive to make him an offer because they know he’s not represented by an attorney. Don’t let yourself get into this kind of situation. Know your rights. Ryan explains how domestic assault works in the state of MN. If you make someone fear for their life and the police are called, 99% of the time, they have to arrest someone and that person will be charged with domestic assault. Oh and by the way, if you are found guilty, you will never be able to legally possess any kind of firearm in the state of MN again. Ryan advised caller there are two types of expungement and the second one is a complex process. If you are pulled over and have been drinking, listen to learn why it’s usually better to take a urine test versus a breathalyzer test. A woman is stopped for speeding but believes she wasn’t. Should she fight it? A caller was pulled over for driving 65 in a 55 MPH zone but said there were no speed limit signs. Ryan said in Minnesota, when the speed limit is not posted the limit is 30 MPH. A 16 old caller with a 3 year old child wants to collect child support from the father but he isn’t paying. Can she send him to jail?
